ATech Ltd – Privacy Policy

 

1.       Introduction

ATech Ltd needs to collect and use certain types of information about the individuals or service users (the “Data Subjects”) who come into contact with ATech Ltd in order to carry on our work. This personal information are stored securely and there are safeguards to ensure this under the Data Protection Act 2004 (the “Act”).

2.       Data Controller

ATech Ltd is theData Controller under the Act, which means that it determines what purposes personal information held, will be used for.

3.       Disclosure

a)       ATech Ltd undertakes not to disclose personal data of a Data Subject without the data subject’s express consent.

b)      However, there are circumstances where the law allows ATech Ltd to disclose data without the data subject’s consent.  

c)       These include:

                                 i.            for the performance of a contract to which the Data Subject is a party;

                               ii.            in order to take steps required by the Data Subject prior to entering into a contract;

                             iii.            in order to protect the vital interests of the Data Subject;

                             iv.            for compliance with any legal obligation to which the data controller is subject;

                               v.            for the administration of justice; or

                             vi.            in the public interest.

d)       ATech Ltd regards the lawful and correct treatment of personal information as very important to successful working, and to maintaining the confidence of those with whom we deal. 

e)      ATech Ltd intends to ensure that personal information is treated lawfully and correctly.

f)        To this end, ATech Ltd will adhere to the Principles of Data Protection, as detailed in the Act.

g)       Specifically, the Principles require that personal information:

                                 i.            Shall be processed fairly and lawfully.

                               ii.            Shall be obtained only any specified and lawful purpose, and shall not be further processed in any manner incompatible with that purpose.

                             iii.            Shall be adequate, relevant and not excessive in relation to the purpose for which they are processed;

                             iv.            Shall be accurate and, where necessary, kept up to date;

                               v.            Shall not be kept for longer than is necessary for that purpose or those purposes;

                             vi.            Shall be processed in accordance with the rights of data subjects under the Act;

                            vii.            Appropriate security and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data; and

                          viii.            Shall not be transferred to a country unless that country ensures an adequate level of protection for the rights of Data Subjects in relation to the processing of personal information.

h)      ATech Ltd will, through appropriate management and strict application of criteria and controls:

                                 i.            Observe fully conditions regarding the fair collection and use of information;

                               ii.            Meet its legal obligations to specify the purposes for which information is used;

                             iii.            Collect and process appropriate information, and only to the extent that it is needed to fulfill its operational needs or to comply with any legal requirements;

                             iv.            Ensure the quality of information used;

                               v.            Ensure that the rights of people about whom information is held, can be fully exercised under the Act;

                             vi.            Take appropriate technical and organisational security measures to safeguard personal information;

                            vii.            Ensure that personal information is not transferred abroad without suitable safeguards and appropriate consents;

                          viii.            Set out clear procedures for responding to requests for information.

4.       Data collection

When collecting data, ATech Ltdwill ensure that the Data Subject:

                                 i.            Clearly understands why the information is needed;

                               ii.            Understands what it will be used for and what the consequences are should the Data Subject decide not to give consent to processing;

                             iii.            As far as reasonably possible, grants explicit consent, either written or verbal for data to be processed;

                             iv.            Is, as far as reasonably practicable, competent enough to give consent and has given so freely without any duress; and

                               v.            Has received sufficient information on why their data is needed and how it will be used

5.       Data Storage

a)       Information and records relating to Data Subjects will be stored securely and will only be accessible to the managing director of ATech Ltd.

b)      Information will be stored for only as long as it is needed and will be disposed of appropriately.

c)       This policy will be updated as necessary to reflect best practice in data management, security and control and to ensure compliance with any changes or amendments made to the Act.
